In these Terms & Conditions, "Community Botanic Dispensary", "we", "us" or "our" refers to Bona Sano Pty Ltd and the pharmacy services we provide through our website, pharmacy premises, prescription ordering systems, delivery services and related communication channels.

By accessing our website, creating an account, submitting a prescription, placing an order, making a payment, requesting delivery, or using our services, you agree to these Terms & Conditions.

Nothing in these Terms & Conditions limits your rights under the Australian Consumer Law or any other law that cannot be excluded. Under Australian Consumer Law, consumers have certain guarantees when buying products and services.

1. About our services

Community Botanic Dispensary provides pharmacy services, including prescription medicine supply, pharmacist counselling, order processing, pickup, delivery and related support.

Our website may allow you to:

  • create an account
  • submit an eScript token or prescription details
  • request prescription review
  • request pricing and availability
  • place an order
  • make payment
  • request pickup or delivery
  • contact our pharmacy team
  • access general information about our pharmacy services.

Prescription medicines are only supplied after pharmacist review and approval.

2. Not medical advice

Information on our website is provided for general information only.

Our website does not provide medical diagnosis, personalised medical advice, treatment recommendations, or a substitute for consultation with a registered health practitioner.

You should speak with your doctor, pharmacist or other qualified healthcare professional before starting, stopping or changing any medicine.

Our pharmacists may provide medicine counselling and dispensing-related support. Diagnosis, prescribing decisions and treatment changes remain the responsibility of your prescriber or treating healthcare practitioner.

3. Prescription medicines

Prescription medicines can only be supplied with a valid prescription from an Australian registered prescriber.

Before supply, our pharmacist must review your prescription and confirm that it is valid, current, legally compliant and appropriate for supply.

We may refuse or delay supply if:

  • the prescription is invalid, expired or incomplete
  • the medicine has already been dispensed
  • repeats are not yet due
  • the prescription details do not match your order
  • required information is missing
  • identity cannot be verified
  • stock is unavailable
  • payment has not been completed
  • prescriber clarification is required
  • pharmacist review identifies a safety, legal or professional concern
  • supply would breach pharmacy, health, medicines, therapeutic goods or professional obligations.

NSW Health provides legal guidance on the supply of Schedule 4 and Schedule 8 medicines in NSW, including prescription requirements.

4. eScript tokens and prescription submissions

You are responsible for ensuring that any eScript token or prescription information you submit is accurate, current and belongs to you or to a person for whom you are authorised to act.

Submitting a prescription or eScript token does not guarantee supply.

We may need to contact you, your prescriber, or another authorised healthcare provider to verify prescription details or resolve issues before supply.

If you submit a prescription on behalf of another person, you confirm that you have authority to do so.

5. Medicinal cannabis and unapproved medicines

Some medicinal cannabis products and other medicines may be unapproved therapeutic goods accessed through special pathways, such as the Special Access Scheme or Authorised Prescriber pathway.

The Therapeutic Goods Administration explains that the Special Access Scheme and Authorised Prescriber pathways allow certain registered health practitioners to access unapproved therapeutic goods for patients under their care.

Your prescriber is responsible for determining whether a medicine is clinically appropriate for you and whether the required access pathway applies.

Product availability, pricing and supply can only be confirmed after pharmacist review.

Prescription medicines and unapproved therapeutic goods, including medicinal cannabis, are subject to advertising restrictions. The TGA states that prescription medicines and unapproved therapeutic goods, including medicinal cannabis, may be advertised only to health professionals, not the general public.

For this reason, our website may not display product lists, pricing or product information in the same way as a general online retail catalogue.

6. Account registration

You may need to create an account to use certain website features, including prescription submission, order management, payment, delivery tracking or communication with our pharmacy team.

You agree to provide accurate, current and complete information when creating or using your account.

You are responsible for:

  • keeping your login details secure
  • not sharing your account access with unauthorised persons
  • notifying us if you suspect unauthorised access
  • ensuring your contact, delivery and identity details are accurate.

We may suspend, restrict or close your account if we suspect misuse, fraud, unauthorised access, privacy risks, safety concerns, or breach of these Terms & Conditions.

7. Orders

An order is not accepted by us until:

  • your prescription has been reviewed and approved by our pharmacist, where relevant
  • stock availability has been confirmed
  • pricing has been confirmed
  • payment has been completed, where required
  • the order has been accepted by Community Botanic Dispensary.

We may refuse, cancel or delay an order where we reasonably believe it is necessary for legal, professional, safety, stock, pricing, payment, fraud prevention, delivery or operational reasons.

We may contact you before finalising an order if further information is needed.

8. Pricing and availability

Prices and availability may change without notice.

For prescription medicines, pricing and availability may only be confirmed after pharmacist review.

The final price may depend on:

  • the medicine prescribed
  • pack size
  • quantity
  • availability
  • delivery method
  • any applicable fees or charges.

We will tell you the final price before payment.

We are not required to supply a product at an incorrect price caused by website error, system error, typographical error, supplier error or other mistake.

9. Payment

Payment must be completed using an approved payment method provided by Community Botanic Dispensary.

We do not recommend sending card details by email, SMS or unsecured message.

Payments may be processed by third-party payment providers. Their own terms, privacy policy and security practices may apply.

An order may not be prepared, dispensed, dispatched or released until payment has been completed, unless we agree otherwise.

10. Pickup

Pickup may be available from:

  • Community Botanic Dispensary, 77 Regent Street, Chippendale NSW 2008

You must wait until we confirm that your order is ready before attending the pharmacy.

Photo ID may be required at pickup.

If someone else collects an order on your behalf, we may require proof of authority, identity verification or other checks before releasing the order.

We may refuse pickup if we are not satisfied that supply is safe, lawful or appropriate.

11. Delivery

Delivery may be available after pharmacist review and approval.

Delivery is subject to:

  • prescription validity
  • medicine availability
  • delivery location
  • courier availability
  • payment completion
  • secure delivery requirements
  • legal and professional obligations
  • pharmacist approval.

Prescription medicine deliveries may require signature, identity verification, secure handover or proof of delivery.

For Schedule 8 medicines delivered by courier or carrier in NSW, pharmacists must keep written evidence of the medicine consignment and evidence of delivery. NSW Health also states that external packaging must not indicate that the contents are Schedule 8 or Schedule 4 Appendix D medicine.

Delivery timeframes are estimates only unless expressly confirmed by us.

12. Returns, refunds and cancellations

Prescription medicines generally cannot be returned, exchanged or refunded once dispensed, unless there is a dispensing error, product fault, recall, damage issue, or another matter requiring pharmacist review.

Change-of-mind refunds are not available for prescription medicines once dispensed.

You may request cancellation before a medicine has been dispensed or dispatched, but cancellation may not be possible in all cases.

This does not limit your rights under Australian Consumer Law. If a product or service does not meet consumer guarantees, you may be entitled to a remedy.

13. Product information and website content

We take reasonable care to ensure information on our website is accurate and up to date.

However, website content may contain errors, omissions or outdated information.

Product images, descriptions, packaging, availability and prices may change without notice.

General website information should not be relied on as medical advice, prescribing advice, product advertising, or a guarantee that a particular medicine is suitable or available for you.

Where there is any inconsistency between website information and pharmacist advice, prescription requirements, legal obligations, supplier information, professional standards or regulatory requirements, those requirements will take priority.

14. Your responsibilities

You agree to:

  • provide accurate and complete information
  • only submit prescriptions that belong to you or someone you are authorised to act for
  • not submit false, altered, expired or misleading prescription information
  • not misuse our website or ordering system
  • not attempt to obtain medicines unlawfully
  • not interfere with website security or functionality
  • not use our website for fraudulent, harmful, unlawful or abusive purposes
  • keep your account login details secure
  • follow pharmacist instructions relating to your medicine
  • check your order, medicine label and delivery details carefully.

You must contact us immediately if you believe there has been an error with your medicine, prescription, delivery or order.

15. Refusal of service

We may refuse, suspend, cancel or limit service where we reasonably consider it necessary, including where:

  • supply may be unsafe, unlawful or inappropriate
  • pharmacist review identifies a concern
  • prescription details cannot be verified
  • identity cannot be verified
  • payment fails or appears fraudulent
  • delivery cannot be completed safely
  • there is abusive, threatening or inappropriate behaviour
  • website or account misuse is suspected
  • supply would breach legal, regulatory, professional or ethical obligations.

16. Privacy

We handle personal information, including health information, in accordance with our Privacy Policy.

By using our website or services, you acknowledge that we may collect, use, store and disclose your information for pharmacy, dispensing, delivery, payment, support, legal, regulatory and operational purposes.

Health information is sensitive information and is handled in accordance with applicable Australian privacy and health records requirements.

17. Third-party providers and links

Our website and services may involve third-party providers, including payment providers, delivery providers, website hosting providers, pharmacy software providers, prescription exchange services, analytics providers and communication platforms.

We are not responsible for third-party websites, platforms, systems or services except to the extent required by law.

If our website contains links to third-party websites, those websites are not controlled by us. You should review their own terms and privacy policies.

18. Website availability and security

We aim to keep our website available and secure, but we do not guarantee uninterrupted, error-free or secure access.

  • failure to follow medicine instructions or pharmacist advice.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under Australian Consumer Law.

21. Indemnity

You agree to indemnify Community Botanic Dispensary, Bona Sano Pty Ltd, its directors, employees, contractors and agents against any loss, damage, claim, liability, cost or expense arising from your breach of these Terms & Conditions, misuse of our website, unlawful conduct, or provision of false, incomplete or misleading information.

This indemnity does not apply to the extent the loss is caused by our negligence, breach of law or breach of these Terms & Conditions.

22. Force majeure

We are not responsible for delay or failure to perform an obligation where the delay or failure is caused by events outside our reasonable control.

This may include natural disasters, severe weather, fire, flood, pandemic, government action, industrial action, supplier failure, courier disruption, power outage, telecommunications failure, cyber incident, system outage, or regulatory change.

The updated version will be published on our website with the updated date.

Your continued use of our website or services after the updated Terms & Conditions are published means you accept the updated terms.

24. Governing law

These Terms & Conditions are governed by the laws of New South Wales, Australia.

You and Community Botanic Dispensary submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
